SGS keeps businesses informed about US mandatory eFiling for consumer products

 

SGS, the world’s leading testing, inspection and certification company, is offering a complimentary webinar on US Consumer Product Safety Commission (CPSC) plans to introduce mandatory eFiling of consumer goods on the Automated Commercial Environment (ACE) system of US Customs and Border Protection (CBP).

 

On December 8, 2023, the CPSC introduced a supplemental notice of proposed rulemaking (SNPR) to amend 16 CFR 1110, part of the Consumer Product Safety Act (CPSA). This will fundamentally change the way consumer products access US markets by introducing a mandatory requirement to file digital compliance data.

 

The new requirements will streamline the process, making it mandatory for finished product certifiers to file a digitized certificate of conformity (CoC) via the CPSC Product Registry before any regulated consumer product can be placed onto the US market. Products covered include those under the scope of the Consumer Product Safety Improvement Act (CPSIA) and existing CPSC regulations and standards.

 

The information required for eFiling generally follows the data needed for a General Certificate of Conformity (GCC) or Children Product Certificate (CPC), but it will involve elements being defined and matched with the CPSC Product Registry system.

 

Timeline of implementation

 

- December 2023 – SNPR introduced to amend 16 CFR 1110
- June 2024 – CPSC eFiling beta pilot ends
- Summer 2024 – voluntary eFiling commences
- September 2024 – 16 CFR 1110 final rule making
- January 2025 – rollout of final eFiling requirements (subject to change)
